Terms of service

Written to be read. Where a clause exists because something actually went wrong or actually gets argued about, it says so rather than hiding behind a paragraph of Latin.

Short version: your photographs stay yours, the images we make for you are yours to sell with, failed generations are refunded automatically, and what comes back is generated rather than photographed, which matters in a few specific places set out below.

01The agreement

These terms cover Flatlay Studio at flatlay.in, its API, and the try-on widget you may install on your own storefront. Using any of them means you accept them.

If you are agreeing on behalf of a company, you are confirming you may bind it.

02Your account

One email is one identity. You are responsible for what happens under your account, so keep the password to yourself and use the invite system for colleagues rather than sharing a login.

Team seats sign in with their own password, which they set themselves. We built it that way deliberately: nobody on your team, including you, should know somebody else's password.

You must be 18 or over and able to enter a contract.

03Plans and credits

Plans are billed monthly or annually through Dodo Payments and grant credits each period. Every action costs credits from that balance. Unused credits do not roll over past the period they were granted in, and top up packs are used before plan credits.

Credits are an internal unit of account. They are not money, they are not transferable, and they cannot be cashed out.

We may change plan prices. If we do, we will tell you before it applies to you, and you can cancel rather than accept it.

04What happens when something fails

Credits come off before a generation runs and go back automatically if it fails. You do not have to ask, and a failed run should never cost you anything.

If that ever does not happen, tell us and we will put it right.

  • A failed generation is refunded to your ledger automatically
  • An interrupted batch resumes rather than stranding what you spent
  • Your first reshoot of any product is free

05Cancelling and refunds

Cancel any time from billing. Your plan runs to the end of the period you have paid for and does not renew.

We do not refund unused credits or part periods, because the cost of generating is incurred when you generate. If something went wrong on our side, that is a different conversation and one worth having: write to saifsiddiqui2409@gmail.com.

06Your photographs and your images

The photographs you upload stay yours. You give us permission to process them only to provide the service: to read the garment, generate from it and store the result in your library. Nothing else.

The images and copy we generate for you are yours to use commercially, including on your storefront, on marketplaces and in advertising. We claim no ownership of your output and we do not reuse your garments for anybody else's sets.

You must have the right to upload what you upload. Photographing somebody else's garment and selling it as yours is between you and them.

07What you may not do

Most of this is obvious. It is written down because the obvious things are the ones that get argued about.

  • Generate images of a real, identifiable person without their permission
  • Generate sexual content, or any depiction of a minor that is not ordinary children's clothing photographed plainly
  • Pass generated imagery off as a photograph of a physical sample where that claim matters, such as in a dispute or an inspection
  • Upload a garment you have no right to, or somebody else's photograph you have no right to
  • Resell raw access to the API as a competing generation service
  • Attempt to work around credit limits, rate limits or the daily try-on cap

08Being honest about generated imagery

What comes back is generated. The garment is carried from your photograph, but the model, the room and the light are made. That is fine for a catalogue frame and it is the whole point of the product.

It is not a photograph of a physical sample, and it should not be used where somebody is relying on it as one. Marketplaces differ on how generated imagery must be labelled and they change their minds; complying with the storefront you list on is your call and your responsibility.

Size charts are derived from the garment as read and are a starting point. Where you have measured the sample, your numbers should win.

09If you install try-on

The widget collects a photograph from your shopper on your storefront. That makes you the one with the relationship to them, and a few things follow from it.

  • Tell your shoppers you are collecting a photograph, and that it is deleted within six hours
  • Do not enable it on pages aimed at children
  • Only register domains you actually control
  • Set a daily cap before going live, because it is the ceiling on what a day can cost you

10Availability

We aim to keep it up and we do not promise a particular uptime. Generation depends on a third party model provider, and when they are slow or down, so are we.

We may change or remove features. If something you rely on is going away, we will tell you rather than let you discover it.

11Liability

Nothing here limits liability for fraud, or for anything the law does not allow us to limit.

Beyond that, and to the extent the law allows: the service is provided as it is; we are not liable for lost profit, lost sales or indirect loss; and our total liability for any claim is capped at what you paid us in the twelve months before it arose.

12Ending it

You can close your account whenever you like. Export anything you want to keep first, because closing it deletes your library. If you want help, saifsiddiqui2409@gmail.com.

We may suspend an account that is breaking the rules above, or that is not paying. Where it is not urgent we will tell you first and give you a chance to fix it.

13Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction.

14Changes

If these terms change in a way that matters, the date at the top changes and we will tell you by email. Continuing to use the service after that means accepting the new version.
